What is an Immigration Psychological Evaluation?

A psychological evaluation adds a remarkable value to an immigration case. This type of evaluation can assist immigration courts to determine a person’s eligibility to legally remain in the U.S. The evaluation consists of questions regarding relevant information to your case such as your immigration status, medical and/or mental health history, work history, and personal/family history. The findings of the evaluation are documented in a comprehensive written report that your attorney can use to support your case and positively impact your immigration proceedings.

Immigration evaluations are performed by Spanish-English Bilingual Psychologists (English/Spanish). Interpreter services are available for other languages.

Immigration evaluations are available in-person or virtually through our Telehealth platform.

TYPE OF EVALUATION

DESCRIPTION

HOW CAN PSYCHOLOGICAL

EVALUATION BE HELPFUL?

Cancellation of Removal

An evaluation for individuals who are in the process of removal proceedings who seek relief from the immigration court.

In deportation proceedings, the evaluation can provide supporting evidence of the emotional, mental health, and extreme hardships caused or exacerbated by deportation to the individuals and their family.

Hardship waivers

(601 & 601A)

An evaluation for individuals seeking waivers on grounds of inadmissibility. They focus on hardship to qualifying family members who are U.S. citizens or lawful permanent residents.

The evaluation can provide clear    documentation of your situation and the hardship caused by an applicant’s removal from the U.S. to qualifying family member who is a citizen or lawful permanent resident. If the hardship includes mental health concerns, an evaluation helps to describe how the separation impacts mental health.

Asylum

An evaluation for individuals who suffered persecution or have a well-founded fear of future persecution in their country of origin.

The evaluation can document the persecution or suffering you experienced prior to arriving to the U.S. and/or the reason for fearing future persecution in your home country. It can also document reasons for failing to apply within the one-year timeframe of arriving to the U.S.

Violence Against Women Act (VAWA)

An evaluation for individuals (women, men, or children) who have experienced physical or sexual abuse, non-violent acts, or threats of violence from a U.S. citizen or lawful permanent resident (LPR) and who are dependent on their abuser to apply for immigration status.

The evaluation can document evidence to demonstrate battery and extreme cruelty, and the psychological and emotional hardship experienced.

U Visa

An evaluation for individuals who have been a victim of a qualifying crime within the U.S., who suffered substantial mental or physical abuse, and who cooperated with law enforcement.

The evaluation can provide an objective assessment of the mental and emotional hardship from the abuse.

T Visa

The evaluation for victims of a severe form of trafficking and who cooperated with law enforcement in the detection, investigation, or prosecution of human trafficking.

The evaluation assesses the applicant’s mental state and the mental and emotional impact of the trafficking.

Medical Certification for Disability Exceptions

(N-648)

An evaluation for individuals who are applying for U.S. citizenship and need to request an exception to the English and civics testing requirements for naturalization due to a physical, developmental, or mental impairment.

The evaluation assesses how an individual’s mental or developmental disability or physical impairment impacts their ability to learn English and U.S. civics. The evaluation can help an applicant obtain a Citizenship Examination Waiver that excepts them from taking the citizenship test as part of the naturalization process.
